Privacy Policy

This Privacy Policy explains how Chargezoom, Inc. (“Chargezoom,” “we,” “us,” or “our”), based in Salt Lake City, Utah, collects, uses, and shares information through Integrater (the “Service”), including through Payment Graph, our payment data network. This Privacy Policy uses the same defined terms as our Terms of Service: “Customer” refers to a business using Integrater to accept payments, and “Payor” refers to an individual or business making a payment to a Customer through Integrater.

This Privacy Policy is incorporated by reference into, and should be read alongside, our Terms of Service. We operate exclusively in the United States and offer the Service to Customers and Payors located in all 50 states.

When a Payor makes a payment through Integrater, or opts in to Payment Graph, we may collect the following Payor Information:

• Cardholder name
• Email address
• Phone number
• Business name
• Payment method details necessary to process the transaction

We also collect information from Customers necessary to set up and operate their account, such as business and contact information.

We use Payor Information for the following purposes:

• To process and complete payment transactions on behalf of Customers.
• For fraud prevention and detection. Reducing fraud across the Payment Graph network is the primary purpose for which we use Payor Information.
• For internal analysis, including creating derivative or aggregated data sets that help us understand and improve the Service.
• To promote additional Chargezoom services to a Payor, unless the Payor has opted out as described in Section 6.

Payment Graph is Chargezoom's payment data network. It allows a Payor to opt in, at the time of a payment, to create a free account and save their Payor Information with Chargezoom so that future payments to Customers on the network can be completed more quickly, and so that Chargezoom can better detect and prevent fraud across the network.

Opting in to Payment Graph is entirely optional. A Payor who declines is still able to complete their payment. A Payor who opts in may opt out at any time, as described in Section 6.

Chargezoom does not sell Payor Information. We may share Payor Information with:

• Customers, to the extent necessary to process a payment or provide support.
• Service providers who help us operate the Service, such as payment processors, banking partners, and fraud-prevention vendors, under obligations to protect that information.
• Regulators, law enforcement, or other parties where required by law or to protect the rights, safety, or property of Chargezoom, our Customers, or Payors.

We may also share derivative or aggregated data, created as described in Section 3, that does not identify a specific Payor.

A Payor who has opted in to Payment Graph may opt out at any time. Opting out means Chargezoom will stop using that Payor's Payor Information for internal analysis and promotional purposes as described in Section 3, and will stop contacting the Payor about additional Chargezoom services. Chargezoom may continue to use Payor Information as necessary to complete payments already in progress, prevent fraud, comply with law, or enforce our agreements.

To opt out, a Payor may contact us using the information in Section 12, or use account settings where available.

We retain Payor Information for as long as necessary to provide the Service, comply with our legal obligations, resolve disputes, and enforce our agreements. If a Payor opts out of Payment Graph, we retain the minimum information necessary to honor that opt-out and to meet other obligations described in this Policy.

We maintain administrative, technical, and physical safeguards designed to protect Payor Information against unauthorized access, use, or disclosure. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

The Service is not directed to individuals under the age of 18, and we do not knowingly collect Payor Information from children.

A number of states have enacted comprehensive consumer privacy laws, including California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia, among others. If you are a resident of one of these states, you may have some or all of the rights described below with respect to your personal information, subject to the exceptions and thresholds set out in the applicable state law.

Your Rights

• Right to Know / Access — the right to confirm whether we process your personal information and to obtain a copy of it.
• Right to Delete — the right to request deletion of personal information we have collected about you, subject to certain exceptions (for example, information we must retain to complete a transaction, prevent fraud, or comply with law).
• Right to Correct — the right to request correction of inaccurate personal information.
• Right to Opt Out of Sale, Sharing, and Targeted Advertising — the right to opt out of the sale of your personal information and, in applicable states, the sharing of personal information for cross-context behavioral advertising. As described in Section 5, Chargezoom does not sell Payor Information and does not use Payor Information for third-party targeted advertising.
• Right to Opt Out of Profiling — the right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects. Chargezoom does not use Payor Information to make this type of automated decision.
• Right to Non-Discrimination — the right not to receive discriminatory treatment for exercising any of these rights.
• Right to Appeal — in states that provide for it (including Colorado, Connecticut, and Virginia), the right to appeal our decision on a privacy request.

How to Exercise Your Rights

You may submit a request to exercise any of these rights by contacting us using the information in Section 12. We will verify your request using information associated with your account or transaction history before responding, and we will respond within the timeframe required by the law applicable to you. You may designate an authorized agent to submit a request on your behalf where permitted by applicable law.

California Residents

In addition to the rights above, California residents may request information about the categories of personal information we have disclosed for a business purpose in the preceding 12 months. Because Chargezoom does not sell personal information as defined under the California Consumer Privacy Act, there is no need to submit a “Do Not Sell or Share My Personal Information” request, though you may still contact us with any questions.

Nevada Residents

Nevada law allows consumers to opt out of the sale of certain covered information. Chargezoom does not sell covered information as defined under Nevada law. Nevada residents may still submit a request through the contact information in Section 12, and we will honor it.

We may update this Privacy Policy from time to time. Material changes will be communicated by posting an updated version with a new effective date. This Privacy Policy is available at https://integrater.com/privacy-policy.
